1- Preamble

The present General Terms and Conditions of Sale are concluded between ·

on the other hand, any natural or legal person visiting, making a purchase on the Site www.maisonsarahlavoine.com, and hereinafter referred to as "the Customer"

2- Definitions

The following definitions shall apply in these general terms and conditions of sale with the meanings set out below (whether used in the singular or plural). 

3- Completeness

The present conditions express the entirety of the obligations of the parties. In this sense, the Customer accepts in advance and without reservation the entirety of the provisions set out in these general terms and conditions. In case of disagreement with the terms and conditions of the Terms and Conditions of Sale, the Customer must not use the Website;

No general or specific condition appearing in the documents sent or handed over by the Customer may be incorporated herein, since these documents are incompatible with these general conditions.

Maison Sarah Lavoine reserves the right to adapt or modify these Terms and Conditions of Sale at any time and without notice, the adaptations or modifications being then applicable to all orders subsequent to these adaptations or modifications;

In the event of a modification, the General Terms and Conditions of Sale applicable to the Customer's order are those that were online, and which the Customer accepted on the day the Order was placed.

The present General Terms and Conditions of Sale aim to define :

7- Product characteristics and prices

7.1. Consultation of product and service characteristics

Maison Sarah Lavoine presents on its Website the products and services as well as their detailed descriptions allowing the Customer to know, before taking a final order, their essential characteristics. The photographs of the products presented on the Site are as faithful as possible but cannot ensure a perfect similarity with the products offered, particularly with regard to colours.

7.2. Availability of products and validity of the offer

Offers of products and services as well as the prices appearing on the Site are valid for the current day. A product that has become unavailable is indicated with the words: "Temporarily unavailable" or "Available in stores and from our partners" in the event that the products presented on the site are possibly still on sale in the physical stores of the brand Maison Sarah Lavoine. It is also specified that the simple fact of adding a product to the basket does not constitute validation of the order. In other words, the product may become unavailable between the time it is added to the basket and the validation of the order by the Customer. In case the unavailability of the product or service would be noted after validation of payment, Maison Sarah Lavoine undertakes to proceed to the cancellation of the order and full refund of the price paid by the Customer. In this case the refund will be made without delay and at the latest within fourteen (14) days of payment of the sums paid by the Client.

7.3. Awards

The prices of the products and services presented on the Site are indicated in Euros, all taxes included (VAT included). They are applicable at the time of order validation by the Customer and do not include the contribution to transport costs, invoiced in addition and indicated on the "Summary" page of the basket before the final validation of the order. The prices are inclusive of VAT (Value Added Tax) for products delivered within the European Union. Items subject to VAT are subject to French VAT. Any change in the legal rates of French VAT will be reflected in the price of the products and services presented on the Site, on the date stipulated by the application decree referring to it.

8- Payment

All prices shown are inclusive of VAT. The total amount of an order is composed of the price of the articles and the delivery costs. You can use the following means of payment: VISA, MASTERCARD and Paypal. If the payment is refused by the authorization center, we will not be able to proceed with the shipment of the order.

9- Confirmation of order

You will receive a confirmation email as soon as we receive your order. Please have the references of this email available for all correspondence. If you do not receive this confirmation email, please contact shop@sarahlavoine.com.

10- Right of withdrawal

In accordance with article L121-20 of the Consumer Code, the Customer has a period of fourteen (14) clear days from receipt of the products to exercise his right of withdrawal, without having to justify his reasons, nor to pay penalties, with the exception, where applicable, of the cost of return.

The fourteen (14) day period runs from receipt of the products: when the fourteen (14) day period expires on a Saturday, Sunday or public holiday or non-working day, it is extended to the first following working day. Maison Sarah Lavoine recommends that the Customer who wishes to exercise his right of withdrawal to inform Customer Service by email to shop@sarahlavoine.com.

11- Delivery

11.1 Shipping costs

The delivery charges dedicated to our online sales site have been established according to the volumes and weight of the product based on the current rates of the post office and our carriers.

11.2 Delivery times

Small and medium items are shipped by Colissimo within 3 to 5 days after order confirmation, subject to product availability. If one or more items are no longer available without this being indicated in the product sheet, the Customer is notified by email or telephone and Maison Sarah Lavoine will proceed to refund these items by crediting the card used to pay for the order.

Larger items will be sent within 4 to 6 weeks according to the information on the product sheet.

11.3 Sending

Any order placed on the Maison Sarah Lavoine online sales site can only be sent to the proposed destinations. For any request for shipment abroad, please contact serviceclient@sarahlavoine.com.

12- Conditions for returning products

The Customer has a legal deadline of fourteen (14) days from the day of receipt of his order to inform Sarah Lavoine of his intention to return the product and the reason for this return.

The return of the product(s) shall be made in their original packaging, intact, accompanied by all possible accessories and documentation, in perfect condition for resale, with the indication of the order number to which the products relate. The product will have to be returned in a packaging provided for this purpose, not allowing the identification of the product (postal parcel, bubble envelope, kraft paper,...). Any product that is damaged, incomplete, missing or whose original packaging has been damaged will not be refunded or exchanged and will be returned to the Customer. Maison Sarah Lavoine recommends that the Customer returns his products with a recommendation or additional insurance guaranteeing, if necessary, compensation for products up to their actual market value in case of spoliation or loss of the package(s).

In the case of returns from abroad, the costs are to be borne by the customer.

During private sales and sales, returns are the responsibility of the customer.

13- Reimbursement

In case of exercise of the right of withdrawal, Maison Sarah Lavoine is required to reimburse the Customer for the sums paid, without penalty, except for shipping costs. The refund is due without delay and at the latest within fourteen (14) days following the date of receipt of the returned products. If the return of the product(s) purchased is due to an error on the part of Maison Sarah Lavoine, the shipping and return costs will then be fully refunded to the Customer.

14- Cancellation

Beyond this withdrawal period, if you wish to cancel your order you must contact shop@sarahlavoine.com. If your order has been shipped, we will ask you to return the products to us by following the instructions provided by email.

If you wish to make changes to your order, change the delivery address or add products, please contact us by email at shop@sarahlavoine.com.

16- Warranties

16.1. transport guarantee

Assuming the risks related to transport, Sarah Lavoine undertakes to deliver the products ordered by the Customer in a closed, resistant packaging, appropriate to the contents and transport requirements. Any product damaged or lost in transit will be replaced. The guarantee linked to transport is only valid if the Customer or his Consignee has signed the delivery note or transport receipt presented by the carrier on which he will have taken care to express precise handwritten, dated and signed reservations. By signing the delivery note or transport receipt, without making any reservations, the Customer acknowledges that his package has not been damaged during transport. In the event of a dispute, the original packaging must be retained until the dispute is resolved. Maison Sarah Lavoine advises the Customer or its Recipient to inform Customer Service by email to shop@sarahlavoine.com within a maximum of 72 hours from delivery, after this period no claim will be taken into account.

16.2. Legal guarantee of conformity

In accordance with Article 211-1 et seq. of the Consumer Code, Maison Sarah Lavoine undertakes to deliver a product that complies with the order validated by the Customer and is liable for any lack of conformity existing at the time of delivery. Sarah Lavoine recommends that the Customer who wishes to exercise his right of guarantee should inform Customer Service as soon as he is aware of it by email at shop@sarahlavoine.com or by telephone at 01 42 60 60 40. This claim must be justified and accompanied by proof of the damage suffered (photos,...) In case of lack of conformity, the Customer may request, to the exclusion of any other compensation or damages: either the replacement of the product, or the refund of the product including transport costs.

The legal guarantee of conformity applies only to the essential characteristics of the products. The photographs of the products presented on the Site are as faithful as possible but cannot ensure a perfect similarity with the products offered, particularly with regard to colours.

16.3. The legal guarantee for defects or hidden defects

In accordance with article 1641 et seq. of the French Civil Code, the Customer also benefits from the legal guarantee of hidden defects on products sold on the www.maisonsarahlavoine.com Website. The implementation of the legal guarantee of conformity does not preclude warranty claims for hidden defects. Four (4) conditions must be met in order for the Customer to benefit from this warranty:

16.5.2. Customer Damage / Product Replacement

In case of replacement following a claim by the Client implementing one of its guarantees, unless otherwise agreed by the parties, the product(s) will be shipped without delay and Customer Service will contact the Client or its Recipient no later than 2 business days after notification of acceptance of acceptance of takeover by Maison Sarah Lavoine.

Reimbursement of the product occurring following a claim by the Customer implementing one of its guarantees: A reimbursement without delay and at the latest within fourteen (14) working days following the date of "notification of acceptance of assumption" will be made. Reimbursement includes: the price of the product(s) that are the subject of the claim, the transport costs relating to the product(s) on the basis of the invoiced price, the return costs incurred by the Customer on production of a supporting document (invoice, etc.).

17- Applicable law

The General Terms and Conditions of Sale are subject to French law. In the event of litigation the Customer will be able to carry out his complaints near the Customer service of Sarah Lavoine by email to shop@sarahlavoine.com&nbsp or by telephone to 01 42 60 60 40 in order to seek an amicable solution. In the absence of an amicable agreement between the Parties, the dispute will be submitted to the French courts, which have sole jurisdiction in this matter.
